To: All interested Agencies, Groups and Individuals This is to give notice that the City of Lipan has determined that the following proposed action under the Community Development Block Grant administered by the Texas Department of Agriculture (TDA) and ERR #(7217259), is located in the 100-year floodplain and wetland, and the City of Lipan will be identifying and evaluating practicable alternatives to locating the action in the floodplain and wetland and the potential impacts on the floodplain and wetland from the proposed action, as required by Executive Order 11988 and 11990, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain and Wetland Management and Protection of Floodplains and Wetlands. Project Description: Contractor shall reconstruct approximately one thousand four hundred five linear feet (1,405 l.f.) of street utilizing HMAC pavement. In addition, to address street flooding, contractor shall install corrugated metal culverts, curb and gutter, drainage pans, pavement repair, and all associated appurtenances. Total Area of Disturbance: 0.7 acres Floodplain According to the FEMA floodplain map # 48221C0025D, a portion of the project will occur a FEMA regulated floodplain (Zone A): Gafford Street starting from approximately 350 S of E Brown Street and extending south approximately 550 feet Area of Floodplain Disturbance: 0.16 acres Wetland According to the USFWS Wetland Inventory Map, a portion of the project cross a Riverine wetland. This wetland will be disturbed in terms of E.O. 11990's definition of new construction. Gafford Street, approximately 600 feet south of E Brown St. Total Area of Wetland Disturbance - 0.027 acres. Natural and beneficial values potentially adversely affected by the activity: 1. A flood could pose a danger to residents and vehicular traffic in the area. As a result of this project, the roadway will be less likely to flood, thereby, making vehicular travel more safe. 2. The natural resources of the floodplain and wetland include water, biological, and societal resources. The proposed project will have minimal impacts to the floodplain because the project involves improving existing roads and drainage facilities in a manner which better addresses drainage along the roadway.In addition, only a very small part of the project crosses a riverine wetland. 3. The project will have no effect on federally listed species or critical habitat and no impact on state-listed species. 4. Societal resources should be improved as a result of this project. The project will be designed to complement the natural features of the area and be aesthetically pleasing. The site will not have an effect on agricultural lands. There are three primary purposes for this notice.  First, people who may be affected by activities in floodplains and wetlands and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas.  Commenters are encouraged to offer alternative sites outside of the floodplain and wetland, alternative methods to serve the same project purpose, and methods to minimize and mitigate impacts. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplains and wetlands can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplains and wetlands, it must inform those who may be put at greater or continued risk.
