AN ORDINANCE AMENDING ORDINANCE NO. 01-819, THE ZONING ORDINANCE OF THE CITY OF GRANBURY, TEXAS, BY GRANTING A SPECIFIC USE PERMIT FOR CERTAIN PROPERTY IN THE CITY OF GRANBURY; REVISING THE OFFICIAL ZONING MAP IN ACCORDANCE THEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY FOR VIOLATIONS HEREOF; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE. SECTION 1. Ordinance No. 01-819, as amended, is hereby amended by granting a Specific Use Permit (SUP) on the property located on an approximate 5.67 acre portion of land described as a part of the U Martin Survey, Abstract 384 located at 4700 E Hwy 377> within the City of Granbury, Hood County, Texas, and located in the Heavy Commercial "HC" zoning district. The Specific Use Permit (SUP) shall be issued to allow for Used Auto Sales and Boat Sales, under the following terms and conditions: 1. The SUP shall expire 1 year from the date of City Council approval (expires September 5, 2018). For the term of the SUP, use and development of the property must be in compliance with the approved site plan attached hereto as Exhibit A; 2. The display area for the cars and boats is located on the west side of the property on approved hard surface as defined by ordinance. In that area, only 2 rows of boats and vehicles are to be parked One row is along E Hwy 377 and the second row is at the back or northern part of the paved area, This arrangement allows a maneuvering lane between the two rows; and 3. Parking, sales and inventory display shall be provided as shown and outlined on the approved site plan. The remainder of the 5.67 acres is not to be used for the sale of used cars and boats unless the SUP/site plan is amended. SECTION 6. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this Ordinance shall be fined not more than Two Thousand Dollars ($2,000.00). Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 8. The City Secretary of the City of Granbury is hereby directed to publish in the official newspaper of the City of Granbury, the caption, Section 1, penalty clause, publication clause and effective date clause of this Ordinance one time as required by Section 2.13 of the Charter of the City of Granbury. EFFECTIVE DATE These ordinances shall become effective from and after its passage. PASSED AND APPROVED on this 5th day of September, 2017. These ordinances are on file in the Office of the City Secretary, 116 W Bridge St and can be seen in its entirety Monday through Friday from 8:00 AM to 5:00 PM.
