ORDINANCE NO. 17-16

AN ORDINANCE AMENDING ORDINANCE NO. 01-819, REVISED ORDINANCE NO. 14-596, THE ZONING ORDINANCE OF THE CITY OF GRANBURY, TEXAS, BY CHANGING THE ZONING CLASSIFICATION FOR CERTAIN PROPERTY IN THE CITY OF GRANBURY; REVISING THE OFFICIAL ZONING MAP IN ACCORDANCE THEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY FOR VIOLATIONS HEREOF; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE. SECTION 1. Ordinance No. 01-819, as amended, is hereby amended by granting within the "PD/R-8.4" Planned Development/R-8.4 Single Family Residential Zoning District in Catalina Bay II, Phase 2 City of Granbury, Hood County, Texas, and being more fully described as: An approximate 71.8-acre tract of Catalina Bay II, Phase 2, Addition, City of Granbury, Hood County, Texas, Attached as: Exhibit 'A' - Map of "the Islands" portion of Catalina Bay Addition. Requirements as amended for "PD/R-8.4" Planned Development/R-8.4 Residential Zoning District Approval of a utility building (96 square feet) in the Common Area at the entrance of the addition including the following conditions and variances that will be made a part of the ordinance. 1. The accessory building will be placed on site according to the attached site plan. 2. Landscaping as proposed by the applicant will hide the utility building from being seen from Water's Edge Drive and Island Drive at the entrance to the subdivision 3. The utility building is for HOA usage only. 4. The Development Plan is hereby amended to place the utility building in the Common Area without a primary building as shown on the attached exhibit. SECTION 7. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this Ordinance shall be fined not more than Two Thousand Dollars ($2,000.00). Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 9. The City Secretary of the City of Granbury is hereby directed to publish in the official newspaper of the City of Granbury, the caption, Section 1, penalty clause, publication clause and effective date clause of this Ordinance one time as required by Section 2.13 of the Charter of the City of Granbury. SECTION 10. This Ordinance shall be in full force and effect from and after the date of its passage and publication as required by law, and it is so ordained.
