ORDINANCE NO. 16-58

AN ORDINANCE AMENDING ORDINANCE NO. 01-819, THE ZONING ORDINANCE OF THE CITY OF GRANBURY, TEXAS, BY GRANTING A SPECIFIC USE PERMIT FOR CERTAIN PROPERTY IN THE CITY OF GRANBURY; REVISING THE OFFICIAL ZONING MAP IN ACCORDANCE THEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY FOR VIOLATIONS HEREOF; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRANBURY, TEXAS THAT: SECTION 1. Ordinance No. 01-819, as amended, is hereby amended by granting a Specific Use Permit (SUP) on the property located on an approximate 6.4 acre portion of land described as Lot 4, Block 1, of the Luton Ranch West Addition, located at 3740 E Hwy. 377, within the City of Granbury, Hood County, Texas, and being more fully described as: An approximate 6.4 acre portion of land described as Lot 4, Block 1, of the Luton Ranch West Addition, located at 3740 E Hwy. 377, within the City of Granbury, Hood County, Texas, and located within the Light Commercial (LC) zoned district. The Specific Use Permit (SUP) shall be issued to allow for the operation of Daily Outdoor Display under the following terms and conditions: a. The Specific Use Permit shall automatically expire 1 year from City Council approval, and; b. Daily Outdoor Display is allowed in the front yard during the hours of 7:00 a.m. to 7:00 p.m. During all other hours the items must be moved inside an enclosed building or moved to an area completely screened from public view. c. Parking spaces shall not be used for display d. The outdoor display will not impede emergency and pedestrian ingress/egress on front entryway SECTION 6. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this Ordinance shall be fined not more than Two Thousand Dollars ($2,000.00). Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 8. The City Secretary of the City of Granbury is hereby directed to publish in the official newspaper of the City of Granbury, the caption, Section 1, penalty clause, publication clause and effective date clause of this Ordinance one time as required by Section 2.13 of the Charter of the City of Granbury. SECTION 9. This Ordinance shall be in full force and effect from and after the date of its passage and publication as required by law, and it is so ordained. PASSED AND APPROVED on this 1st day of November, 2016. This ordinance is on file in the Office of the City Secretary, 116 W Bridge St and can be seen in its entirety Monday through Friday from 8:00 AM to 5:00 PM.
