AN ORDINANCE AMENDING ORDINANCE NO. 01-819, REVISED ORDINANCE NO. 11-456, THE ZONING ORDINANCE OF THE CITY OF GRANBURY, TEXAS, BY GRANTING A SPECIFIC USE PERMIT FOR CERTAIN PROPERTY IN THE CITY OF GRANBURY; REVISING THE OFFICIAL ZONING MAP IN ACCORDANCE THEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY FOR VIOLATIONS HEREOF; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRANBURY, TEXAS, THAT:
SECTION 1.
Ordinance No. 01-819, as amended, is hereby amended by granting a Temporary Specific Use Permit on the property located at 641-645 Reunion Ct. and being more fully described as:
An approximate 28.991 acre portion of land commonly known as the Reunion Grounds within the Ballard's Addition, Lot 1R and addressed as 641-645 Reunion Ct. in the City of Granbury, Hood County, Texas, located in a Heavy Commercial 'HC' zoned district with a Temporary Specific Use Permit (SUP) to allow for the operation of an outdoor amusement center (carnival) during September 19, 2016 - October 5, 2016 as defined by the City of Granbury Zoning Ordinance. Exhibit "A", is attached as the Site Plan for the Temporary Carnival.
The following conditions apply to this SUP:
a. The applicant will need to file and have an approved Event/Festival Permit with the City prior to mobilizing the carnival venue to the site;
b. Entrance & exit along Reunion Ct. must be coordinated with Local Officials (especially Police/Fire), and
c. The Temporary Carnival will be valid for the following days after which it will automatically expire and become null and void: September 19 through October 5, 2016. As per the SUP application there will be 3 days for set-up and 2 days for take-down.
SECTION 6.
Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this Ordinance shall be fined not more than Two Thousand Dollars ($2,000.00). Each day that a violation is permitted to exist shall constitute a separate offense.
SECTION 8.
The City Secretary of the City of Granbury is hereby directed to publish in the official newspaper of the City of Granbury, the caption, Section 1, penalty clause, publication clause and effective date clause of this Ordinance one time as required by Section 2.13 of the Charter of the City of Granbury.
SECTION 9.
This Ordinance shall be in full force and effect from and after the date of its passage and publication as required by law, and it is so ordained.
