AN ORDINANCE AMENDING ARTICLES 1.50.518 OF THE CITY OF GRANBURY, TEXAS, CODE OF ORDINANCES; PROVIDING FOR THE ADDITION OF NEW FEES AND AMENDMENT OF CERTAIN OTHER FEES ADOPTED BY SAID ORDINANCE; PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.

AN ORDINANCE AMENDING ORDINANCE NO. 01-819, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF GRANBURY, TEXAS, BY GRANTING A SPECIFIC USE PERMIT FOR CERTAIN PROPERTY IN THE CITY OF GRANBURY; REVISING THE OFFICIAL ZONING MAP IN ACCORDANCE THEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY FOR VIOLATIONS HEREOF; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE.
SECTION 1.
Ordinance No. 01-819, as amended, is hereby amended by granting a Specific Use Permit on the property addressed as 415 E. Hwy 377 as described in Exhibit 'A' and depicted in Exhibit 'B', in the City of Granbury, Hood County, Texas, and more fully described as:
An approximate 12.656-acre portion of land platted as Lot 3R, Home Depot Overstreet Addition, addressed as 415 E. Hwy 377, in the City of Granbury, Hood County, Texas, and located in the 'HC' Heavy Commercial district to allow for "Trailer Sales/Rentals", "Construction Equipment Sales/Rentals", "Portable Building Sales", and Outdoor Storage with the following terms and conditions under the issuance of a Specific Use Permit:
1. Compact Power Rental Equipment shall be limited to those depicted and per the specific description of each equipment as shown on the 2-page document titled "Compact Power Rental Equipment" (Exhibit B).
2. All placement of "Trailer Sales/Rentals", "Construction Equipment Sales/Rentals", "Portable Building Sales" and Outdoor Storage shall be as shown on the site plan (Exhibit C) with an applicant revision date of October 11, 2022; except if otherwise indicated in these conditions.
3. A landscape plan showing screening of the THD (The Home Depot) Equipment Rental shall be submitted at the time of Building Permit review. The landscape plan screening shall be shown within the Overstreet Boulevard landscape planter extending from THD's west drive to the middle drive of THD's site. The planting shall include a row of mature canopy trees planted 50-feet on center (suggestion Shumard Oak), a row of low-level screening shrubs planted a 3-feet on center, being a minimum of 3 feet mature height (suggestion Abelia); and abutting the parking lot/storage area a row of high level screening shrubs planted 5-feet on center (suggestion Burford Holly) providing a minimum 8 foot tall screening hedge. The screening shall be installed within six months of the approval of this SUP and be maintained thereafter.
4. The THD Equipment Rental along Overstreet Boulevard shall not be greater than 8 feet in total height.
5. A site plan depicting the following shall be submitted at the time of Building Permit review. The site plan shall show the limits of the outdoor storage and is only allowed in areas shown on the site plan as submitted and with the following:
a. The site plan shall show vehicular maintenance access to:
i. the detention basin through the existing gate access to the detention basin at the southeast corner of the site, and
ii. the existing gate to the detention pump station at the southeast corner of the site. The accesses shall be permanently delineated with yellow hatch paint and sign posted no parking or storage is allowed.
b. The gutter line following all curb lines shall remain clear of any outdoor storage for a distance of three feet from the front of the curb. The site plan shall depict this area and be noted as "outdoor storage not allowed".
6. Except as provided in these conditions, the SUP shall be subject to the Supplemental Standards as contained in the Zoning Ordinance.
7. This SUP is subject to all other City Code requirements, permits, periodic inspections; and an inspection fee as established in the City's Master fee schedule.
8. Any violation of the supplemental land use standards or terms and conditions stipulated in the SUP may be deemed in violation of the zoning ordinance and the SUP may become null and void and/or the Certificate of Occupancy may be revoked.
9. The existing wall shall remain, with the exception of the wall that extends past the new curb line for the new fire lane as shown on the site plan with an applicant revision date of October 11, 2022.
SECTION 6.
Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this Ordinance shall be fined not more than Two Thousand Dollars ($2,000.00). Each day that a violation is permitted to exist shall constitute a separate offense.
