AN ORDINANCE AMENDING ORDINANCE NO. 01-819, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF GRANBURY, TEXAS, BY GRANTING A SPECIFIC USE PERMIT FOR CERTAIN PROPERTY IN THE CITY OF GRANBURY; REVISING THE OFFICIAL ZONING MAP IN ACCORDANCE THEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY FOR VIOLATIONS HEREOF; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRANBURY, TEXAS, THAT: SECTION 1. Ordinance No. 01-819, as amended, is hereby amended by granting a Specific Use Permit on the property addressed as 2608 E. US 377, in the City of Granbury, Hood County, Texas, and more fully described as: An approximate 0.4 acre portion of land platted as Lot 19 of the East Park Addition, addressed as 2608 E. US 377, in the City of Granbury, Hood County, Texas, and located in the 'HC' Heavy Commercial district to allow for the daily outdoor display, sales and service of used motorcycles with the following terms and conditions under the issuance of a Specific Use Permit: 1. The Specific Use Permit shall expire in one (1) year from the date of City Council approval; 2. Motorcycles shall be displayed as delineated on the attached site plan. Outdoor repair is prohibited. The merchandise shall be situated in a manner not to block ingress/egress to the building or required parking spaces; 3. The outside display will be allowed during standard business hours, 7:00 a.m. to 7:00 p.m. SECTION 6. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this Ordinance shall be fined not more than Two Thousand Dollars ($2,000.00). Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 8. The City Secretary of the City of Granbury is hereby directed to publish in the official newspaper of the City of Granbury, the caption, Section 1, penalty clause, publication clause and effective date clause of this Ordinance one time as required by Section 2.13 of the Charter of the City of Granbury. PASSED AND APPROVED ON THIS 5TH DAY OF JULY, 2016. This ordinance is on file in the Office of the City Secretary, 116 W Bridge St and can be seen in its entirety Monday through Friday from 8:00 AM to 5:00 PM.
