AN ORDINANCE AMENDING ORDINANCE NO. 01-819, REVISED ORDINANCE NO. 11-456, THE ZONING ORDINANCE OF THE CITY OF GRANBURY, TEXAS, BY GRANTING A SPECIFIC USE PERMIT FOR CERTAIN PROPERTY IN THE CITY OF GRANBURY; REVISING THE OFFICIAL ZONING MAP IN ACCORDANCE THEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY FOR VIOLATIONS HEREOF; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRANBURY, TEXAS, THAT:
SECTION 1.
Ordinance No. 01-819, as amended, is hereby amended by granting a Specific Use Permit on the property located on approximately 14,000 sq. ft. on 2.047 acres of land recorded as Lot 1R, Block 2, of the Original Town of Granbury addressed as 201 E. Pearl Street, City of Granbury, Hood County, Texas and being more fully described as:
An approximate 2.047 acres of land recorded as Lot 1R, Block 2 of the Original Town of Granbury, addressed as 201 E. Pearl Street, City of Granbury, Hood County, Texas, and located within the Central Business District (CBD), with a Specific Use Permit (SUP) to allow for the operation of a 'General Market' and 'Farmer's Market' as defined by the City of Granbury Zoning Ordinance under the following terms and conditions:
a. The Specific use Permit shall automatically expire after five (5) years from the date of City Council approval;
b. General or Farmer's Market activity shall only take place within the confines of the pavilion (under the roofline), and within the 5,000 sq. ft. area on the parking lot as delineated on the Site Plan, Exhibit 'A';
c. General and Farmer's Market activity, including set-up or tear down, shall not begin until 7:00 a.m. and shall cease by 8:00 p.m.; and,
d. Any music or amplified noise equipment shall be limited to the hours of 10:00 a.m. to 10:00 p.m. on Sundays through Thursdays, and 10:00 a.m. to midnight on Fridays and Saturdays. Amplified levels during this time allowance period shall not exceed the accepted standards for decibel readings contained within the City's Code of Ordinances.
e. All activities shall meet the requirements of the Zoning Ordinance. Specifically cited are the Definitions (Article 12) and Supplemental Standards (Article 4) for a Farmer's Market and General Market.
SECTION 6.
Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this Ordinance shall be fined not more than Two Thousand Dollars ($2,000.00). Each day that a violation is permitted to exist shall constitute a separate offense.
SECTION 8.
The City Secretary of the City of Granbury is hereby directed to publish in the official newspaper of the City of Granbury, the caption, Section 1, penalty clause, publication clause and effective date clause of this Ordinance one time as required by Section 2.13 of the Charter of the City of Granbury.
SECTION 9.
This Ordinance shall be in full force and effect from and after the date of its passage and publication as required by law, and it is so ordained.
