AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRANBURY, TEXAS, AMENDING THE GENERAL FUND AND TOURISM FUND FOR FISCAL YEAR 2017-2018. ORDINANCE NO. 18-26 AN ORDINANCE AMENDING ORDINANCE NO. 01-819, THE ZONING ORDINANCE OF THE CITY OF GRANBURY, TEXAS, BY GRANTING A SPECIFIC USE PERMIT FOR CERTAIN PROPERTY IN THE CITY OF GRANBURY; REVISING THE OFFICIAL ZONING MAP IN ACCORDANCE THEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY FOR VIOLATIONS HEREOF; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE. SECTION 1. Ordinance No. 01-819, as amended, is hereby amended by granting a Specific Use Permit (SUP) on the property located on an approximate 1.73 acre portion of land described as a part of the Milam County School Land Survey, Abstract 348 located at 1301 W Pearl St., within the City of Granbury, Hood County, Texas, and being more fully described as: An approximate 1.73 acre portion of land described as a part of the Milam County School Land Survey, Abstract 348 located at 1301 W Pearl St., within the City of Granbury, Hood County, Texas, and located within the Heavy Commercial "HC" zoned district. The Specific Use Permit (SUP) shall be issued to allow for Used Auto Sales, Major Auto Repair and ATV sales and/or service, new and used under the following terms and conditions: 1) The Specific Use Permit (sale of used cars, ATV sales and service, new and used and major auto repair) shall expire 1 year from the date of City Council approval (expires April 3, 2019). 2) The property will be developed and used in general conformance with site plan attached herein as Exhibit "A". 3) The display area for the cars and ATVs is located on the east side of the property on approved hard surface as defined by ordinance. All parking and maneuvering lanes shall also be on approved hard surface. Parking shall be installed, striped and inspected prior to any uses allowed under the SUP to occur on the site. 4) Parking, sales and inventory display shall be provided as shown and outlined on the approved site plan. The remainder of the 1.73 acres is not to be used for the sale of used cars and ATVs unless the SUP/Site Plan is amended. 5) The building will be clad with a minimum of 30% exterior masonry content as required and defined by the zoning ordinance; and 6) Vegetative (evergreen) screening shall be installed on the east side of the property adjacent to the apartments and parallel to the auto sales area. Vegetative screening shall be between 6-8 feet in height and maintained by commercial user. The plantings will be opaque, sufficient to create a solid screening barrier. SECTION 6. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this Ordinance shall be fined not more than Two Thousand Dollars ($2,000.00). Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 8. The City Secretary of the City of Granbury is hereby directed to publish in the official newspaper of the City of Granbury, the caption, Section 1, penalty clause, publication clause and effective date clause of this Ordinance one time as required by Section 2.13 of the Charter of the City of Granbury. PASSED AND APPROVED ON THIS 3RD DAY OF APRIL, 2018. These ordinances are on file in the Office of the City Secretary, 116 W Bridge St and can be seen in its entirety Monday through Friday from 8:00 AM to 5:00 PM.
